What is fizy?

With fizy, you can listen to your favorite music, podcasts, and audiobooks; watch video clips, find song lyrics, and access songs, playlists, and albums offline even when you don't have internet access. With fizy, you can discover songs you've never heard before through radio stations tailored to your music taste or personalized playlists, and enjoy all this content in high sound quality.

Whether you're at home, on vacation, or on the go, millions of pieces of content are always with you with fizy! Thank you for using fizy!

The fizy Terms of Use (referred to as “Terms”) on this page contain basic information about the use of fizy (“Service”) via the mobile application or website (“fizy.com”) and some rules that we mutually have agreed with you to comply with.

We are aware of the fact that reading this text can be tedious. We try to minimize your effort by using a concise and straightforward narrative. We recommend you to read these Terms carefully. You must accept the Terms in order to use fizy. If you do not agree with any part of these Terms, you should not use fizy. By registering with fizy or accessing fizy via fizy.com, you are deemed to have accepted these Terms.

Lifecell Müzik reserves the right to suspend your use of fizy if it determines or if it reasonably believes that you are not complying with the Terms of Use. For detailed information, please refer to the section “Suspension and Termination” hereunder.

In addition to the information provided here, we also have a privacy notice (fizy Privacy Notice) regarding the processing of your personal data that you share for the purpose of using the Service and that is generated during your use. You can find details regarding the processing of your personal data here.

Service Ownership Information

Fizy is provided by Lifecell Müzik Yayın ve İletim A.Ş. having its registered office at Aydınevler Mahallesi İnönü Caddesi No:20 Küçükyalı Ofispark 34854 Maltepe/İstanbul, registered with the Istanbul Trade Registry Office under registration number 243668-5 and tax ID number 6081256771 (“Lifecell Müzik” or “we”).

Depending on your geographic location, you may enter into contractual relationships with third parties that Lifecell Müzik collaborates with in the scope of your use of fizy. In this case, we remind you that the provisions of the relevant contracts will also apply in conjunction with these Terms.

General Terms

Age Restriction You must be at least 13 years old to use fizy. If you are between 13 and 18 years old, you must read these Terms together with your parent or guardian and obtain their consent.

Membership You must create a membership to use fizy. You can find the membership types and fees on the Memberships page at fizy.com or in the “All Plans” tab of the fizy mobile app.

If you have acquired a gift code or access rights for fizy membership sold and/or provided by third parties,we remind you that other terms and conditions determined by these third parties may also apply to your use of fizy.

If Lifecell Müzik determines that you do not meet the requirements for your selected membership type, it is entitled to take any of the actions listed in section “Suspension and Termination” deemed as necessary.

Your Account If you create an account on fizy, you must keep your username, password, and payment information confidential and not share them with any third party. If you believe or suspect that someone, other than you, has access to this information, please notify us immediately at destek@fizy.com.

You may delete your fizy account at any time. When you delete your account, (your email address, mobile phone number, username, name and surname information, membership packages you have subscribed to, playlists and video playlists, artist likes, list of songs you have liked, albums you have saved, lists and video lists you follow, listenlog - your listening and viewing data -, your login history, etc.) will be stored for 30 (thirty) days from the date you delete your account and if you log back into your account within these 30 (thirty) days, you can continue to use your account as before. However, if you do not log in to your account in any way during this 30 (thirty) day period, the information in question within the scope of fizy will be permanently deleted at the end of 30 (thirty) days.

Links Links from fizy to third-party websites are provided solely for your convenience or when communicating with other users. If you use these links, you will leave fizy. Lifecell Müzik does not have any control these websites and is not responsible for these websites, their content, or their accessibility. Lifecell Müzik does not endorse or represent these websites or the materials available on these websites in any way. Accessing third-party websites from fizy is entirely your responsibility.

Changes and Revisions Lifecell Müzik may revise the content of the Terms at any time. You should check this section from time to time to learn about any changes we have made. If we make a change to the Terms that is of significant importance, we may provide more visible notifications (including via email or through fizy).

Assignment Lifecell Müzik may freely assign fizy and/or its rights and obligations under these Terms to any third party or entity at any time without notifying you. This does not affect the obligations you must fulfill under these Terms. You may not assign or transfer your rights, obligations, and responsibilities arising from these Terms to any third party in any manner whatsoever.

Terms of Use

This section contains other specific rules that you must comply with when using fizy, in addition to the other requirements set forth in the Terms.

When using fizy, you accept and undertake that

• you will not provide false information about your account details, you will not allow anyone else to use your account, you will not act under someone else's identity without his/her consent, or not give the misleading impression that you are acting on behalf of another person, institution, or organization,
• you will not use fizy in a manner that is incompatible with personal use or in a manner that cannot be considered normal,
• you are solely responsible for the use and management of all information enabling the use of fizy, every transaction made from your own devices and accounts will be considered to have been made by you personally and you are solely responsible for any damage caused by the direct or indirect use, loss, or transfer of this information,
• you will not modify, tamper with or hack fizy, circumvent its features used for security and content protection, or interfere with fizy through reverse engineering or similar means, and you will not support third parties acting for this purpose,
• you will not damage fizy and Lifecell Müzik or the hardware of any fizy user by placing viruses, Trojan horses, worms, logic bombs, script automation tools, or other similar material thereon knowingly, or not misuse fizy with the intent of negatively impacting the user experience of fizy, and not use any automation tools or functions to access fizy (e.g., robots, spiders, scrapers, etc.), not use fizy for data mining or other data collection purposes, and you will not support third parties acting for such purposes,
• you will not copy, reproduce, delete, modify, distribute, display, process, publish the content, or you will not make attempts in this direction,
• you will not use fizy in any way that constitutes a crime, requires legal action, results in the violation of national or international laws and international agreements, or encourages such situations; that is illegal, threatening, harassing, insulting, abusive, defamatory, degrading, rude, pornographic, disruptive to public order, or contrary to public morality, disturbs or harasses others, infringes on personal rights, or violates the privacy rights, personal life, or property rights of others,

and that you will be personally liable for such actions otherwise.

Charging, Renewal and Cancellation

Charging For paid memberships, membership fees, billing, and payment terms may vary depending on the type of membership. You can find detailed information on the “My Memberships” page on fizy.com or in the “My Current Plan” tab of the fizy mobile app.

In order to be able to use fizy, you must pay the fee determined based on the membership type you have selected. If you do not fulfill this payment obligation, your use of fizy may be suspended or terminated.

If you purchase fizy together with products and/or services supplied by third parties, you will also be obliged to pay the fee of the third-party product and/or service in order to continue using fizy; otherwise, your use of fizy may be suspended or terminated.

The internet access required to use fizy as well as any charges and responsibilities arising therefrom are your responsibility. In case you are unable to access fizy or cannot benefit from fizy fully due to reasons caused by your internet service provider, Lifecell Müzik will bear no liability.

You must use the latest version for fizy to work properly. Supported devices and versions are listed on the fizy pages in the relevant app stores. Older versions of fizy may be removed from the scope of support at Lifecell Müzik's discretion. Therefore, in case you are unable to access fizy or cannot benefit from fizy fully due to reasons caused by your internet service provider, Lifecell Müzik will bear no liability.

Renewal and Cancellation The conditions regarding the renewal and cancellation of your fizy membership may vary depending on the type of membership you have purchased, and the terms and conditions in the Distance Selling and Subscription Contract will apply in this regard.

If you purchased your membership through app stores, you can perform all your membership, cancellation, and payment transactions through the relevant app store. We would like to emphasize that Lifecell Müzik has no involvement or responsibility regarding membership cancellations and membership fee refunds made through app stores.

Intellectual Property Rights, Contents and License

Intellectual Property Rights Lifecell Müzik is the owner or licensee of all intellectual property rights related to the fizy application, fizy trademarks, trade names, logos, domain names, and all other elements of the fizy brand, as well as the Content, except for the open-source codes used in fizy. Aforesaid rights are protected worldwide by copyright laws and international agreements. You can access the principles regarding the open-source codes used in fizy and the use of these open-source codes under the Developers tab on fizy.com and the About the Application tab in fizy. You may use the open-source codes provided here only in conformity with the terms of use of the relevant open-source code.

License Granted to You for Your Use of fizy Except for any open-source code that may exists, we grant you a non-exclusive, non-transferable, revocable, time-limited license to use fizy solely for personal, non-commercial purposes and in accordance with these Terms, on condition that you accept these Terms. Therefore, we inform you that you must not act in a manner that exceeds the scope of the specified license, otherwise you may be held legally liable.

Contents on fizy All contents (“Contents”), including contents included on fizy an created by users (“User Content”) (e.g., playlists created by users and their names), is for the personal use of the user. Any commercial use of the Content is prohibited. Otherwise, Lifecell Müzik reserves all rights to compensation.

We hereby inform you that you will be personally liable for any intellectual and industrial property rights infringements arising from your use of the Content in a manner that does not comply with these Terms, and that Lifecell Müzik may seek recourse from you for any damages and losses it may incur as a result thereof, including any fees it may be required to pay to rights holders or professional associations.

User Content and the Rights You Grant Us In case the User Content is shared in a manner accessible to other users on fizy (e.g., through shared playlists), you accept that Lifecell Müzik may use such User Content without paying any fees and without any restrictions and may also permit third parties to use it under the same conditions. In this case, you grant us a worldwide, irrevocable, universal, non-exclusive, royalty-free, and perpetual license of use in order to use, copy, reproduce, distribute, adapt, reformat, modify, publish, translate, and sublicense the said User Content.

The User Content within fizy is not controlled or monitored by Lifecell Müzik. However, to the extent technically and practically feasible and at our sole discretion, we may subsequently review, monitor, reject, modify, or delete any User Content that we deem inconsistent with the Terms of Use. Lifecell Müzik does not guarantee partial or full access to the User Content or the recording of the User Content in the form in which it is sent, received, or used by you in any way.

Content Violations If you believe that any content violates your rights or the rights of a third party you represent, or violates the Terms of Use, please notify us by sending an email to destek@fizy.com.

When sending us a notification in this context, please include the following information in your email:

1. your name and contact details,
2. the location of the content believed to be infringing on fizy and which of the following it infringes: (i) your rights, (ii) the rights of a third party you represent or (iii) Terms of Use and
3. description, explanation and owner of the right alleged to be infringed.

Lifecell Müzik will take the actions or measures it deems appropriate based on the nature of the content you report. This includes not taking any action, if Lifecell Müzik determines that the content in question does not violate anyone's rights or the Terms of Use. Lifecell Müzik is not obliged to discuss the action or actions it chooses to take following your report or to inform you about these matters.

Lifecell Müzik is entitled to suspend and terminate the accounts of users who violate the Terms of Use. If you misuse the notification channels, you may face similar consequences as well.

All information you provide in your request, such as your name and email address, is included in the content of your request for removal and may be shared with relevant parties, including the party being complained about. You can find detailed information about the processing of your personal data in the fizy Privacy Notice.

Problems and Legal Disputes which may be experienced in connection with the Service

Suspension and Termination Any use of fizy that is inconsistent with the above-mentioned Terms of Use and exceeds the scope of the license granted to you constitutes a material violation of the Terms and may lead us to take any or all of the following actions:

1. immediate, temporary, or permanent termination of your right to use fizy and deletion of the relevant user content,
2. compensation of all damages arising from the violation by you, and/or
3. sharing information about the violation with the competent authorities to the extent deemed necessary.

The actions that may be taken in the event of a violation are not limited to those listed above, and Lifecell Müzik will be entitled to apply other sanctions and take legal action as it deems appropriate. Therefore, you agree not to make any claims against Lifecell Müzik.

Interruption or Change in Service Lifecell Müzik will make reasonable efforts to ensure the proper functioning of fizy. However, in certain circumstances (force majeure, technical issues, maintenance, testing, or work to implement legal requirements, etc.), temporary interruptions may occur due to necessary updates. Lifecell Müzik is entitled to change or cease the fizy service and/or Contents, in whole or in part, temporarily or permanently, at any time, without prior notice or consent, and without providing any reason.

Disclaimer Lifecell Müzik reserves the right to restrict access to fizy at any time without prior notice. Lifecell Müzik shall not be liable in any way for the unavailability of fizy at any time and for any period of time, or for any technical problems, errors, or deficiencies you may encounter while using fizy. Upon being notified of such an error, Lifecell Müzik will make reasonable efforts to correct the error as soon as possible.

Natural disasters, war, mobilization, fires, government and administrative decisions, and similar circumstances which occur to such an extent suspending and/or render the Service impossible, partially or completely, temporarily or permanently, shall be considered force majeure. In such cases, Lifecell Müzik shall not be liable to you for its failure to fulfill its obligations.

Lifecell Müzik makes no representations or warranties regarding the Service and provides the Service “as is” without any conditions or guarantees. Lifecell Müzik is not liable for any loss or damage (direct or indirect) arising from the use of fizy. However, in any case, the total liability of Lifecell Müzik to you or your legal heirs in connection with the use of fizy or any claim related to fizy is limited to the amount you have paid to Lifecell Müzik in the last twelve months for the use of fizy.

Severability If any provision of these Terms is held to be invalid, the remaining provisions shall remain in full force and effect to the extent permitted by law.

Jurisdiction and Governing Law Any dispute relating to fizy shall be settled exclusively by the courts and enforcement offices of Istanbul Anatolian Court of Justice, subject to Turkish law, without regard to the rules of conflict of laws. However, Lifecell Müzik reserves the right to file a lawsuit in your country of residence or a relevant third country for any violation of these Terms of Use.
