Personal data collected and processed by Lifecell Müzik Yayın ve İletim A.Ş. (“Lifecell Müzik”) are protected by Lifecell Müzik. Your personal data are processed by Lifecell Müzik within the scope of the fizy Clarification Statement, in accordance with the Personal Data Protection Law no. 6698 (“Law”).

Lifecell Müzik takes technical and administrative measures to ensure secure storage and lawful processing of personal data in accordance with the Law using the applicable technology and infrastructure.

This Clarification Statement herein regulates through which methods the personal data can be obtained, used and shared.

Your Personal Data That May Be Processed by Lifecell Müzik

Even though the information indicated in this statement may vary depending on the products and services used by persons or their request and consents, the categories of personal data which may be processed by Lifecell Müzik are as follows.

  1. Identity Information: Name and surname, tax identification number, names and surnames of the third parties saved in the phone books of the users.
  2. Contact Data: Phone number, e-mail address.
  3. Subscription Data: User name, customer ID, package data, name and surname, e-mail address, other data on use of products and services, information on bills, debts and payments, invoice addresses of the subscribers who pay with credit cards.
  4. Personalization Information: User name, Profile picture.
  5. Sales Channel Data: The data provided by you in the sales process, data acquired through digital and physical means, call logs stored as per the call center standards, records of your voice as requested by you for ID confirmation, data on your requests and transactions in the sales channels.
  6. Data on Use of Products and Services: These are your personal data collected as a result of your use of fizy; data on your fizy plan, date and time of your requests, songs you listened to, the playlists you created, contents of the videos you watched, and your interactions with other fizy users as well as the data on your interactions with fizy, preferences on the use of products and services, your habits and other usage, your conduct on the website and the mobile application, and the device, network, application and usage data collected by the cookies and the mobile application.

Method, Purpose and Legal Basis of Processing Personal Data

Your personal data may be processed by means of fully-automated or partially-automated methods on the website, the mobile applications, by electronic mail and through the interactive voice response system according to the following legal reasons and purposes.

    Processing purposes: Meeting the obligations stipulated in the laws fizy is subject to (e.g. Personal Data Protection Law no. 6698, Consumer Protection Law no. 6502, etc.) and performing the activities.

  2. Requirement to process the personal data of an agreement’s parties provided that the processing of personal data is directly related to the drawing up or performance of the agreement

    Processing purposes: Provision, pricing and invoicing of products and services; meeting and following up your requests regarding the products and services purchased and/or used; personalizing the service and improving your experience (by providing customized, personalized or localized contents, suggestions, features and ads), promotion and marketing of products and services, reaching you, informing you on offers, campaigns, discounts, benefits, terms, prices, subscription, awards, lotteries, contests, and fulfilling the necessary procedures for their use; carrying out targeted promotion, sending you messages for special celebrations and messages of good wishes, sending you the contents you like, you may want to access again, and you will be pleased to be reminded of, understanding how you reach and use the service to ensure technical functionality of the service, develop new products and services, and analyze the use of service; the improvement, diversification, measurement, inspection and analysis of the products and services; the training of employees, assessment of your interest in products and services, consumer complaints, dispute resolution, analyzing the level of customer satisfaction; providing call center services, responding to your questions, complaints and notifications, preventing fraud including unauthorized use of the services.

  3. If data processing is required for Lifecell Müzik to be able to meet their legal liabilities

    4. The data listed in this Clarification Statement will be processed in cases in which it is required to meet the legal liabilities of Lifecell Müzik.

    Processing purposes: Provision, pricing and invoicing of products and services; meeting and following up your requests regarding the products and services ordered, purchased and/or used; informing you on benefits, terms, prices, subscription, lotteries, contests and awards, and fulfilling the necessary procedures for their use, preventing fraud including unauthorized use of the services, responding to user requests and complaints, managing processes, data processing activities that are required to protect the rights of the parties or ensure their security arising from the secondary legislation that fizy is subject to for the resolution of potential disputes are included within this scope.

    Processing purposes: Allowing other users to view your data such as your profile photo and user name

    6. Personal data may be processed in cases where it is necessary for the user and third parties to be able to exercise their rights originating from the law or provided by Lifecell Müzik.

    Processed data: Identity Information, Contact Data, Usage Information.

    Processing purposes: Provision, pricing and invoicing of products and services; meeting and following up your requests regarding the products and services purchased and/or used; exercising the legal rights of the user and third parties particularly the fundamental rights and freedoms arising from the laws before all competent authorities; the use of additional benefits provided by fizy and other institutions and organizations, the use of the rights gained as a result of the lottery and survey activities, meeting all relevant requests, and the execution of the complaint and management processes are included within this scope.

  6. Requiring the processing of personal data for the legitimate interests of Lifecell Müzik

    7. Lifecell Müzik will be able to process personal data in case it is required for their legitimate interests making sure that the fundamental rights and freedoms of the user are not harmed. In case the personal data are processed based on this condition, Lifecell Müzik clearly determines what their legitimate interests are and ensures the balance between their interests and the rights of the users. The protection of the fundamental rights of the users, particularly the privacy of their private lives, their confidentiality and personal rights, is the first priority.

    Processing purposes: Measuring and improving the service quality, service analysis, audit and control, risk management, detection of unauthorized and fraudulent use, management of the user survey process, product and strategy development.

  7. In case of your Express Consent>

    8. In case of your express consent for the following purposes; your identity information, contact data, subscription data, personalization information, your information in sales channels, and your product and service use information are processed:

    1. Promotion and marketing of products and services, reaching you, informing you on campaigns and discounts, offering advantages related with subscription, events and financial advantages and performing the procedures regarding their use,

Providing you with offers, gifts and promotions; promotions offered with the intent of analyzing and profiling, carrying out targeted promotion; sending you messages for special celebrations and messages of good wishes, sending you the results of awards, lotteries and contents you like, you may want to access again, and you will be pleased to be reminded of,
    3. The promotions of the products and services we offer in collaboration with our business partners and 3rd parties, and their own products and services.

To Whom and For What Purposes Are the Personal Data Transferred?

Lifecell Müzik will be able to transfer your personal data to the recipient groups listed below in accordance with the Law for the purposes indicated in this Clarification Statement:

  1. Local and international Turkcell İletişim Hizmetleri A.Ş. (“Turkcell”) group companies and third parties authorized to act on behalf of Turkcell including Lifecell Müzik as listed at https://www.turkcell.com.tr/tr/hakkimizda/genel-bakis/istiraklerimiz
  2. Third parties for the purposes of providing, analyzing and developing the services (including but not limited to data storage, maintenance services, database management, internet solutions, payment procedures and improving service features),
  3. Suppliers and business partners for the purposes of delivering or transporting the products or services to your location,
  4. Regulatory and supervisory institutions, other official institutions and organizations authorized to request your personal data,

Your Rights Concerning Your Personal Data

You can exercise your following rights concerning your personal data as per the 11th article of the Law:

  1. Learn whether or not your personal data are processed,
  2. Request relevant information if your personal data was processed,
  3. Learn about the purpose of processing of your personal data and whether or not they are used in accordance with such purpose,
  4. Learn the local and international third parties to whom your personal data is transferred,
  5. Request correction of your personal data which were processed inaccurately or deficiently,
  6. Request deletion or destruction of your personal data within the frame of the provisions stated in the 7th article of the Personal Data Protection Law,
  7. Request notification to be sent to the third parties to whom your personal data were transferred concerning the correction, deletion or destruction of your personal data,
  8. Object to the processing of your personal data exclusively by means of automated systems,
  9. Request compensation of any loss suffered as a result of illegal processing of your personal data.

About the Clarification Statement

This Clarification Statement will be effective as of the date of issue by Lifecell Müzik. Lifecell Müzik may amend this Clarification Statement as required from time to time. Amendments made by Lifecell Müzik will be effective as of the date of issue of the Clarification Statement at www.fizy.com
