We work hard to offer fizy to you in the best way possible and to make sure nothing comes between you and your favorite music. While doing this, we process some of your personal data. It is your right to know for what purposes and which data we use. Within this scope, we have put together this text to ensure transparency in our data processing processes and give you the control as much as possible.

Personal data collected and processed by Lifecell Müzik Yayın ve İletim A.Ş. (“Lifecell Müzik”) are under the protection of Lifecell Müzik. Your personal data are processed by Lifecell Müzik in line with the Applicable Data Protection Legislation* within the scope of fizy Privacy Policy.

Lifecell Müzik takes technical and administrative measures to ensure secure storage and lawful processing of personal data in accordance with the Applicable Data Protection Legislation using the applicable technology and infrastructure.

I. WHAT ARE PERSONAL DATA?

We process some of your personal data to offer you the fizy service in the best possible way. Personal data refers to data which personally identify you or make you personally identifiable. Categories of personal data which may be processed by Lifecell Müzik are as follows:

Identity Information: This data category covers the data in your phonebook including names and surnames as well as your own name and surname.
Contact Data: This data category covers phone numbers, e-mail addresses etc.
Subscription Data: This data category covers user name, customer ID, package data, name & surname, e-mail address, other information on the use of products and services, information regarding invoices, debts and payments, and invoice addresses of customers who pay with credit cards, etc.
Location Data: This data category covers data on the device and the SIM card, user data on using the products and services, technical data required for providing the services, etc.
Sales Channel Data: This data category covers the data provided by you in the sales process, data acquired through digital and physical means, call logs stored as per the call center standards, records of your voice as requested by you for ID confirmation, data on your requests and transactions on the sales channels.
Data on Use of Products and Services: This data category covers your personal data collected as a result of your use of fizy, data on your fizy plan, date and time of your requests, songs listened to by you, your created playlists, video contents and interactions with other fizy users as well as data on your interactions related with fizy, use of products and services, habits and usage, your conduct on the web site and the mobile application, cookies and device, network, application and usage data collected by the mobile application.

II. FOR WHAT PURPOSES DO WE PROCESS YOUR DATA?

Your personal data may be processed for the following purposes in line with the applicable legislation on protection of personal data:

Provision, pricing and invoicing of products and services; meeting and follow-up of your requests regarding the products and services purchased and/or used,
Customization of the services and improvement of your experience (through custom, personalized and localized contents, proposals, features and ads).
Promotion and marketing of products and services, reaching you, informing you on campaigns, discounts, benefits, terms and prices, offering advantages related with subscription, events and financial advantages and performing the procedures regarding their use,
Offering gifts and promotions, making targeted presentations, sending you gifts, presents and celebration messages as well as contents you may want to gain access, use of data provided by you in relation to an award, draw, contest etc. for the relevant event,
Understanding how you reach and use the service to ensure technical functionality, develop new products and services and analyze the use of service,
Development, diversification, measuring, control and analyzing of products and services, training of employees, assessment of your interest in products and services, analyzing the level of customer satisfaction; providing call center services, responding to your questions, complaints and notifications,
Preventing fraud including unauthorized use of the services,
Offering features, data, ads and other contents based on your location.

WHO CAN YOUR DATA BE TRANSFERRED TO?

Lifecell Müzik may transfer personal data to the local and international receiver groups listed below in line with the Applicable Data Protection Legislation and for the purposes set forth in this Policy:

Local and international Turkcell İletişim Hizmetleri A.Ş. (“Turkcell”) group companies and third parties authorized to act on behalf of Turkcell as listed at https://www.turkcell.com.tr/tr/hakkimizda/genel-bakis/istiraklerimiz and https://www.turkcell.com.tr/tr/hakkimizda/genel-bakis/yurt-disi-istiraklerimiz including Lifecell Müzik,
Third parties for the purposes of providing, analyzing and developing the services (including but not limited to data storage, maintenance services, database management, internet solutions, payment procedures and improving service features),
Suppliers and business partners for the purposes of delivering or transporting the products or services to your location,
Regulatory and supervisory institutions as well as competent courts and execution offices and other official authorities authorized to request your personal data,

IV. HOW ARE YOUR PERSONAL DATA COLLECTED AND WHAT IS THE LEGAL REASON?

Your personal data can be collected automatically, semi-automatically or manually based on your consent for processing of personal data or on the grounds set forth in the Applicable Data Protection Legislation through dealers, call center, web sites, mobile apps, SMS and other written, audio or digital platforms and processed or transferred for the purposes listed in this Policy.

As stipulated by the local or international legislation Lifecell Müzik is subject to,
n case of physical challenges, if you are not in a position to give your consent or if the data process is required to protect the life or physical integrity of the person whose consent is legally invalid or a third-party real person,
Provided that it is directly related to the establishment or execution of an agreement, if processing of the data of the parties to the agreement is required or for the purposes of providing the requested products and services or meeting the requirements of the agreement,
If data processing is required for Lifecell Müzik to meet its legal liabilities,
If it is publicly disclosed by you,
If data processing is required for establishment, use or protection of a right,
If data processing is required for Lifecell Müzik's legitimate interest provided that your rights and freedoms are not injured.

V. WHAT ARE YOUR RIGHTS ON YOUR DATA?

If your country of residence is a EU country, your rights for protection of personal data will vary based on the applicable General Data Protection Regulation (“GDPR”) as follows.

If you are resident in a European Union country, you are entitled to the following rights by applying to Lifecell Müzik with the methods listed in “Contact” section of this Policy

Request relevant information if processed,
Learn about the purpose of processing of your personal data and whether or not they are used in accordance with such purpose,
Learn about local and international third parties to whom such data are transferred,
Request correction of personal data which were processed inaccurately or deficiently,
Request deletion or termination of your personal data as per GDPR,
Request notification of the correction, deletion and termination processes to third parties to whom your personal data are transferred,
Objecting to any result with a negative impact on you as a result of the analysis of the processed personal data solely by automatic systems,
Request compensation of any loss suffered by you as a result of illegal processing of your personal data,
Request not to be subject to automatic decisions or profiling by analysis of the processed personal data solely by automatic systems,
Where possible, request the personal data in a usable format and/or transfer of such data to an organization or institution

Learn about the purpose of processing of your personal data and whether or not they are used in accordance with such purpose,
Learn about local and international third parties to whom such data are transferred,
Request correction of personal data which were processed inaccurately or deficiently,
Request deletion or termination of your personal data as per KVKK,
Request notification of the correction, deletion and termination processes to third parties to whom your personal data are transferred,

Print out the Personal Data Application Form, fill it in and send it to the address “Turkcell Genel Müdürlük Aydınevler Mahallesi İnönü Caddesi No: 20 Küçükyalı Ofis Park B Blok - Maltepe/Istanbul” by means of notary public
Provide detailed information on your request in Personal Data Application Form and send it using the “Contact Us” tab in fizy or to destek@fizy.com

VII. USE OF THE APPLICATION

You must be 18 years of age or older to use fizy. In certain countries, the age of maturity may be higher than 18. In such case, you should be at the age of majority to use the application. If you are younger than 18, you can use the application only under the control and by approval of the parents or legal guardians

VIII. ABOUT THE POLICY

This Policy will be effective as of the date of issue by Lifecell Müzik. Lifecell Müzik may amend this Policy as required from time to time. Amendments by Lifecell Müzik will be effective as of the date of issue of the Policy at www.fizy.com Major changes in the Policy will be notified to you via at least one of the following methods: SMS, e-mail, invoice or fizy push-notification.
